When filing a First Report of Injury or Illness to your Insurance Carrier

·	Complete First Report of Injury or Illness (LES form DWC-1). The employee should sign, if possible, and receive a copy of the First Report.
·	Send First Report of Injury or Illness to your insurance carrier within seven (7) days of your knowledge of the accident or illness. Failure to report in time can result in a Division penalty of up to $1,000.

Claims Frequently Asked Questions

Q.	What injuries should I report to my insurance company? Any injury for which an employee seeks medical attention from an outside medical provider or loses time from work should be reported.
Q.	First aid cases do not have to be reported to the carrier. What is considered a first aid claim? A first aid claim is generally one in which the employee seeks treatment within the company from an on-site company employed nurse or provider. If further treatment is required from an outside medical provider, the injury will not be considered a first aid claim.
Q.	Can I pay the medical bills for minor claims without submitting them to my insurance carrier? No. Not only must all claims other than first aid cases be reported to the carrier, all medical bills, even if you have a deductible policy, should be submitted to your carrier for payment. The carrier will pay according to the appropriate reimbursement schedule. Since the carrier may also have managed care discounts, paying your own medical bills not only could be more expensive, but could also cause you to lose your managed care defense. Section 440.105(4)(b)6F.S., makes it unlawful and a felony to conceal information regarding an employer’s loss history for purposes of avoiding or reducing the true amount of workers’ compensation premium.
Q.	When does a claim become lost time, and when will my employee receive a check? If an employee is unable to work for more than seven days, he is entitled to benefits from the carrier. The first seven days is considered the waiting period and will not be paid unless the employee is disabled for more than 21 days. The carrier must make the first payment by the 14th day of lost time and the employee should receive a check every 14 days thereafter as long as he remains unable to work.
Q.	If I have a drug free workplace and a drug test is done when medical treatment is rendered for an injury, does the carrier pay for the test? A drug test is not considered part of the medical treatment, and your carrier may elect not to pay for it. You are receiving a 5% reduction in premium for maintaining a drug free workplace.
Q.	Do I need to report any injury to the carrier if the employee did not timely report one to me or if I do not believe an accident happened on the job? Yes. As soon as you have knowledge that an accident occurred or that an employee is claiming one did, you should immediately report it to the carrier so that any early investigation can be done. All injuries are to be reported to the carrier within seven days of an employer’s knowledge. Failure to report timely will result in the Division of Workers’ Compensation assessing a fine against the employer.
Q.	What can I, as the employer, do to help keep a claim out of litigation? Keep in contact with the injured employee. Let him/her know you are concerned about his/her welfare and reassure him/her that his job will be available when he/she recovers. Make certain that the claims representative handling the case is providing timely and appropriate benefits. Since the average weekly wage is one of the most litigated workers’ compensation issues, be certain to provide the carrier with timely and accurate wage statements.
Q.	Can I fire an employee who is on workers’ compensation for reasons unrelated to his claim? Prior to terminating an injured employee, the employer should discuss the situation with a labor attorney. Not only is it possible that the Americans With Disabilities Act may come into play, but the termination will make it very difficult to conclude or manage the workers’ compensation claim. It is unlawful to discharge or refuse to hire an employee or job applicant because he has filed a claim for benefits under workers’ compensation.
